Ifta' has a long tradition which is traceable back to the prophet. Since then it fullfills an important function in the social life of Muslims.
Meanwhile, new media were developed, in which fatwas were also distributed. Every medium is characterized by certain qualities. So the question arises, if the new media have an influence upon ifta'. For this purpose, an amount of fatwas has been examined, most of them published in the Saudi newspaper Arab News and in the internet. In Arab News fatwas were distributed since 1981, whereas the distribution of fatwas via internet began almost in 1995.
Since then more than 14.000 fatwas have been published there. The half of the fatwa-distributors are attached to the Wahhabia, another large part to the Shia.
Fatwa-archives and fatwa-online-services should be distinguished:
- fatwa-archives correspond to the classical fatwa-anthologies, but the fatwas are now published via internet instead in books,
- fatwa-online-services answer directly via internet to the posed questions.
The most famous muftis who were online, are Yusuf Qaradawi, Ibn Baz, Ayatollah Sistani and Ayatollah Khamenei. The largest fatwa-online-service IslamiCity has already responded to 4 000 questions in public and to 2 000 questions privately.
The classical legal problems are now discussed online, but there are some new topics discussed that are relevant to the computer, mainly:
- the islamic copyright,
- the regulation of gender relationships in the internet.
In the second half of the book the development of a classical topic of the islamic law under the influence of new media is examined. More than 400 fawas on alcohol have been collected. These could be separated into many different cases, which also exemplifies how far the prohibition of alcohol ranges. Several cases could time and again be linked to technological contexts, which are exemplifying the influence - mainly of the internet - on ifta', on the contents of the fatwas and on law development, at least in the area of the prohibition of alcohol.
